Probate is the court-supervised process of validating a will and ensuring that the dictates of the will are followed. Typically a personal representative or executor is either named in the will or, if one is not named or there is no will, one will be appointed by the court. The personal representative is responsible for several steps.

These steps include assessing the value of the possessions, paying off debts including taxes, notifying creditors and getting the items to the right people. If there is no will, the state will follow the “intestate succession” rules for the distribution of assets.
